In the event of withdrawal, the client is not entitled to a refund of paid amounts.

Code and Programming Issues:

Awamer Al Shabaka provides the best security programs for all company servers, along with professional systems handled by a specialized team. The company establishes several controls and standards for using scripts and codes. Many scripts run on outdated programming systems that pose risks, despite many efforts to obtain the latest programming technologies to ensure maximum security against breaches. Therefore, the company disclaims responsibility for failures resulting from the use of such scripts and is not obliged to refund any payments in such cases.

Free Website Transfer Service:

The company provides free website transfers without damaging the content or encountering issues related to server migration, provided the content remains intact. Therefore, Awamer Al Shabaka is not responsible for any damages caused by differences between versions. The core service is uninterrupted hosting, as clearly stated and mandatory.

Email Newsletters:

Awamer Al Shabaka strictly prohibits sending emails using forums to communicate with members or through newsletters. The company equips servers with an automatic monitoring system that shuts down violating websites immediately when sending messages. The website is suspended for three hours on the first violation, three days on the second violation, and so on, until it is permanently shut down, fined, and provided with a backup for the client to transfer the website. The client is not entitled to a refund for the hosting fees.

Awamer Al Shabaka prohibits publishing any audio or video files unless permission is granted by the producing entity, which holds the intellectual property rights. This includes files like WAV and MP3.

Prohibited Items for Hosting:

The client is allowed to use the provided script for their account, and the company has the right to suspend the service without prior notice if server slowdown is detected due to the use of a particular script.

Website Protection Against Hacking:

All hosting and servers provided by Awamer Al Shabaka are equipped with strong protection against hacking, continuously monitored by specialized security websites. The company warns those with open script access to close all vulnerabilities, and the company reserves the right to terminate the service without notice if the terms of use are violated.

Leased Servers:

• Clients using leased servers with advanced payments, whether monthly, quarterly, semi-annually, or annually, must notify the company 10 days before the end of the contract. Upon payment due date, service cancellation is only allowed after bill payment, and failure to pay may result in a legal action.
• If the client cancels the service, it includes the cancellation of all contents and files on the server gradually, along with the server’s cancellation. The company is not responsible for any loss of files after the client’s approval of service cancellation. The client can request a backup before the specified cancellation date.
• Awamer Al Shabaka provides all technical and programming services for tasks the client cannot handle.
• The company’s responsibility is to protect hosted websites, set up DNS, fix technical issues, update internal programs, and install and update additional programs. The company is not responsible for protecting the client’s server.
• Ongoing server updates and updates to the added programs within the server, such as Security Mode, Farewell, are carried out. The company is not responsible for upgrades like Kernel, MySQL, Php, unless the client specifically requests them.
• All the terms and conditions outlined above for hosting servers apply to all clients and must be followed without exception.

Data Backup Protection:

Awamer Al Shabaka provides daily backups for clients with hosted websites on the company’s servers to protect client data. The client is responsible for backing up data using the control panel at any time. If data is lost, and the client requests a backup from the company, this will incur a fee, and will be done at a specified time.

Client Responsibility:

The client is fully responsible for securing their password, username, and all activities arising from their account.

Client Misconduct:

The client must adhere to proper conduct when dealing with Awamer Al Shabaka staff. The company reserves the right to take action against those who neglect or mistreat Awamer Al Shabaka’s team, including immediate account suspension or final deletion. In such cases, the client loses all financial rights.

Domains:

Awamer Al Shabaka offers domain registration services through verified and accredited entities, and the client must comply with the terms and policies regarding domain name registration through official entities. The domain registration contract does not automatically renew, and a reminder will be sent via email before the contract expires.

Free Domains and Names:

When the client registers a free domain name, they cannot obtain ownership until one year from the registration date, which is the free period provided by Awamer Al Shabaka. The name remains under Awamer Al Shabaka’s control, and after the year ends, the client has the right to renew and acquire ownership of the domain.

Legal Responsibility:

Awamer Al Shabaka is not responsible for refunding any payments if the client fails to comply with the aforementioned terms and conditions, violates the company’s policies, or refuses the company’s decision to suspend or temporarily halt services.

Renewed Contracts:

The contract is automatically renewed after the specified period by Awamer Al Shabaka for another similar period. The client must pay all applicable fees for renewal. If payment is delayed for more than five days after the renewal date, the service will be temporarily suspended until payment is made. Additional fees may apply if the site is reopened after being suspended, and failure to pay within 15 days will result in a permanent service suspension. The company is not responsible for any damages caused by service suspension.

Warranty:

Awamer Al Shabaka provides adequate guarantees for the continued operation of the website on its servers. If the website or domain name is suspended due to reasons outside the Kingdom of Saudi Arabia’s control, Awamer Al Shabaka is not responsible for that suspension and is not obligated to compensate for domain name cancellation or website downtime.

Awamer Al Shabaka has a fair usage policy for all hosting services on its site. Clients cannot exceed more than 10% of resource usage for a single website. Violators will be suspended for six hours, and if the violation is repeated, the suspension time will double, and it could lead to permanent website closure. The client can request to move to a dedicated server.

Financial Section:

If there is any disagreement between the client and the company or any financial disputes, the client must notify Awamer Al Shabaka within five days from the date of the issue. Financial amounts are non-refundable, and the company is not responsible for errors resulting from services that are incompatible with hosting, as all terms were previously clarified.

Termination of Contract for Current Clients:

If the client wishes to terminate the contract, they must send a fax to Awamer Al Shabaka 48 hours before the contract expiration date to notify the company of the termination request. This is applicable for hosting and monthly support clients. For server clients, the company should be notified at least ten days before the invoice is issued to avoid mandatory payment. The company may escalate the matter to the relevant authorities in case of neglect.

Service Termination:

• Awamer Al Shabaka is solely responsible for terminating the service provided to any client who has violated the aforementioned conditions and policies agreed upon with the company. In such cases, the client loses all financial rights.
• The company has full rights to refuse hosting any website that violates the terms and conditions outlined above.
• Misuse of the free coupon for purchases offered by Awamer Al Shabaka results in permanent service termination without financial rights.
• These terms represent a complete agreement between Awamer Al Shabaka and the client, and no other agreement contrary to these terms is valid. The company reserves full rights to suspend services for violators after notification.

Design:

• The client requesting the service must provide all required information to complete the contract, such as the name and website to be designed.
• Design work will not commence until the due payment for the design is received. The client will pay half of the amount before starting work and the rest upon completion, or in installments as agreed with the company.
• The client should provide a clear idea of the initial design concept and features they want, including preferred fonts or colors. This enables the company to provide the best service.
• The company provides a dedicated page to display the price for each design and the time it takes to complete. This time is only for presenting the sample to the client, not the final delivery, as changes may occur based on the client’s wishes.
• The company cannot shorten the design time as it depends on creativity and talent.
• Once the client approves the design sample and the actual work begins, it is difficult to make further modifications.
• The client cannot remove the ownership rights of the design from Awamer Al Shabaka. If the client wishes to do so, they must pay an agreed amount to transfer ownership. Anyone who removes ownership without consulting the company is violating the law and subject to legal action.
